The H-2A Programme

The H-2A programme is a federal, non-immigrant visa programme that allows agricultural employers in the United States to hire foreign workers for seasonal jobs that are difficult to fill. Through the Jamaican Central Labour Organisation (JCLO), Jamaican workers have a long-standing tradition of participating in the H-2A programme, providing vital labour to U.S. farms and agricultural businesses. These workers typically return home after each work season and may be rehired by the same employer year after year.

Programme Requirments

TRANSPORTATION: H-2A employers are responsible for covering travel expenses for all non-local workers (both U.S. and foreign), including inbound and outbound transportation, meals, and overnight lodging during transit. Foreign workers must also be reimbursed for all visa-related costs in the first workweek. The JCLO provides guidance to ensure that Jamaican workers receive proper travel support and reimbursement.

HOUSING: H-2A employers must provide free, approved housing for all non-local workers. These accommodations undergo annual inspections by the State Workforce Agency (SWA) or other housing authorities. The JCLO assists in ensuring that housing meets regulatory standards and that Jamaican workers have access to safe and comfortable living arrangements while employed abroad.

WAGE & WORK HOURS: H-2A employers must offer full-time employment (35+ hours per week) at a government-assigned wage rate based on occupation. Employers must also guarantee at least 75% of the specified work hours over the contract period. The JCLO ensures that Jamaican workers receive fair wages and adequate working hours as per programme regulations.

RECRUITMENT: H-2A employers must make efforts to hire local U.S. workers before recruiting foreign workers. This includes advertising the job online, posting internally at their place of business, and accepting referrals from the local State Workforce Agency (SWA). The JCLO facilitates the recruitment of Jamaican workers by connecting employers with experienced and skilled agricultural labourers.
