The H-2B programme is a federal, non-immigrant visa programme that enables U.S. employers to hire foreign workers for temporary, non-agricultural jobs that are difficult to fill. Jamaican workers have played a crucial role in this programme, contributing their skills across various industries. The JCLO works closely with U.S. employers to ensure fair and ethical recruitment and placement of Jamaican workers.

Programme Requirments

TEMPORARY NEED: H-2B employers must demonstrate that their need for foreign workers is temporary and legitimate. First-time employers may undergo additional scrutiny by the U.S. Department of Labor. The JCLO provides guidance to ensure Jamaican workers are placed with reputable employers who meet programme requirements.

TRANSPORTATION: H-2B employers must cover travel expenses for all non-local workers, including transportation to and from Jamaica, meals, and any required overnight lodging during transit. Foreign workers must also be reimbursed for visa-related costs within the first workweek. The JCLO ensures that Jamaican workers receive proper travel assistance and reimbursement in accordance with programme guidelines.

WAGE & WORK HOURS: H-2B employers must provide full-time employment (35+ hours per week) at a government-mandated wage rate. Employers must also guarantee at least 75% of the specified work hours in each 12-week period. The JCLO works to secure fair wages and working conditions for Jamaican workers under the H-2B programme.

RECRUITMENT: H-2B employers must attempt to hire local U.S. workers before recruiting foreign workers. This includes advertising job opportunities and accepting referrals from the local State Workforce Agency (SWA). The JCLO ensures that Jamaican workers are connected with legitimate job opportunities through ethical recruitment practices.
